1. Service Description

1.1 Border Module
Mërgata provides estimated border waiting times for informational purposes only. Data may come from different public sources or users and may not always be accurate or up to date.

1.2 Rides Module
Mërgata acts solely as a carpooling connector. We do not provide transportation services, verify driver or passenger backgrounds, or guarantee any ride arrangements. Users are responsible for their own compliance, safety, and behavior.

1.3 Community Module
The Community section allows users to post and browse listings (Jobs, Housing, Other). Posts are user-generated and automatically expire after 30 days.

2. Eligibility & Accounts

2.1 Age Requirement
Mërgata is intended for users aged 18 and above. Each user may hold only one account. You must provide accurate information and keep your login credentials secure.

2.2 Geographic Use
The app is designed primarily for the Albanian diaspora. There are no country-specific restrictions; however, users must comply with applicable local laws and international sanctions.

3. User Content & Moderation

3.1 Allowed and Prohibited Content
Users may post normal, lawful content. Prohibited content includes illegal goods or services, hate speech, harassment, scams, explicit material, personal data disclosure, or any discriminatory or fraudulent activity.

3.2 License to Host Content
By submitting content, you grant Mërgata a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, and process your content solely for operating and improving the service.

3.3 Moderation Rights
Mërgata reserves the right to hide, unhide, or delete content and to suspend or terminate accounts that violate these Terms or our policies.

3.4 Intellectual Property & Takedown
If you believe your copyright or IP rights have been infringed, please email support@mergata.al with details. Content may be removed while an investigation is ongoing.

4. Rides Disclaimer & Responsibilities

4.1 Liability
Mërgata is not a party to any ride agreements and provides no warranties regarding matches, user behavior, or trip outcomes. The app currently does not process payments between users.

4.2 Legal Compliance
Users are responsible for complying with all applicable road, insurance, and licensing laws.

4.3 Safety Guidance
Meet in public locations, verify details before traveling, and report any concerns using in-app tools.

5. Border Module Disclaimer

Mërgata makes no guarantees about the accuracy or timeliness of border wait-time information. It is provided for general informational purposes only.

6. Community Module Rules

All posts must include accurate information and location. Spam, duplicate posts, discriminatory listings, and misleading content are prohibited. Posts automatically expire after 30 days; editing a post does not reset the expiry timer.

7. Prohibited Conduct

Users must not:

• Scrape or copy data from the app.
  

• Reverse-engineer or interfere with app operation.
  

• Misrepresent identity or create multiple accounts.
  

• Post others’ personal information without consent.
  

• Use the service for unlawful or harmful purposes.
  
  

8. Communications

8.1 Push Notifications
Push notifications require opt-in permission from your device settings and can be disabled at any time through your OS preferences.

8.2 Marketing Messages
Mërgata currently sends only service or transactional notifications, not marketing messages.

9. Intellectual Property & License

The Mërgata app and all related materials are owned by Mërgata. Users receive a limited, non-exclusive, revocable, non-transferable license to use the app for personal purposes only. All intellectual property remains with Mërgata.

10. Third-Party Services

Mërgata may contain links to external websites or third-party services. We are not responsible for their content, accuracy, or policies. Use of third-party services is at your own risk.

11. Service Availability & Changes

The service may occasionally be unavailable due to maintenance, updates, or unforeseen issues. Mërgata may modify or discontinue features at any time without notice.

12. Account Termination

Mërgata may suspend or terminate accounts that violate these Terms or applicable law. Users may delete their accounts at any time through the in-app settings.

13. Disclaimers, Limitations, and Indemnity

The app and its services are provided “as is” and “as available”, without any warranties or guarantees of performance, reliability, or accuracy.
To the maximum extent permitted by law, Mërgata and its affiliates are not liable for indirect, incidental, or consequential damages arising from the use of the app.
Users agree to indemnify and hold harmless Mërgata, its affiliates, and staff from any claims, losses, or damages resulting from their content, conduct, or misuse of the service.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Kosovo.
Any disputes will be subject to the exclusive jurisdiction of the courts in Kosovo, except where mandatory local consumer protection laws apply.

15. Changes to Terms

Mërgata may update these Terms from time to time. Users will be notified via in-app message or email. The effective date will always be shown at the top of this document. Continued use of the service means you accept the updated Terms.
